What is an Accessory Dwelling Unit (ADU)?
An Accessory Dwelling Unit (ADU) is a secondary, self-contained living space located on the same property as a primary residence. These units are often referred to as in-law apartments, granny flats, backyard cottages, or secondary suites. ADUs are typically smaller in size, ranging from a detached unit in your backyard to a basement or attic conversion within your main home. With growing demand for housing solutions, ADUs have become a popular and affordable option for homeowners looking to maximize their property’s potential.

How to Get a Permit for an ADU
To build an ADU in Massachusetts, you need to obtain multiple permits from various departments within your municipality. A few of them are listed below.

Health Department
If you are currently on septic, you need to ensure your system meets local and Title 5 requirements to handle the increase in capacity.

Conservation Department
If you are located within a buffer zone of a resource area (i.e. wetland, bank, river, etc.) we will need to file a Notice of Intent (NOI) with Conservation to obtain approval.

Building Department
Some cities and towns have specific rules about where and how ADUs can be built. It’s important to understand the local zoning regulations before you begin your project. We will work hand and hand with local architects to submit the necessary plans to bring your ADU to reality.

How long will it take?
Unfortunately, this doesn’t happen overnight. Obtaining permits and approvals can take anywhere 1-6 months depending on which departments you need approval from. However, Chongris Engineering has great working relationships with many municipalities to help expedite this process.
Who is Eligible for an ADU?
In Massachusetts, homeowners who meet the following criteria are eligible to build an ADU:
Owner-Occupied Property
The primary residence must be owner-occupied, meaning the property owner lives there full-time.
Zoning Compliance
Your property must be in a zoning district that allows ADUs, although regulations may vary by town or city. Many municipalities have relaxed rules around ADUs to help ease housing shortages.
Title 5 Compliance
Local zoning codes often restrict the size, design, and location of ADUs on your property. The ADU must comply with regulations to maintain neighborhood character and ensure public safety.
Benefits of an Accessory Dwelling
ADUs offer a variety of benefits for homeowners and communities, including:
Additional Income
Rent out your ADU for passive income or offer it as temporary housing for family members.
Multigenerational Living
An ADU allows families to live close together while maintaining privacy, perfect for elderly parents or adult children.
Increased Property Value
Adding an ADU can increase the value of your home by improving its overall square footage and making the property more versatile.
Sustainable Living
ADUs are eco-friendly, often requiring fewer resources to build and maintain compared to larger homes, and they promote sustainable, efficient use of existing infrastructure.
Affordable Housing Solution
ADUs contribute to the growing need for affordable housing in Massachusetts by providing smaller, lower-cost living spaces.
